Acceptance of These Terms

These Terms and Conditions govern access to and use of the Piping Hot Pizza Cones online shop and the purchase of physical or downloadable products through the website.

By placing an order, the customer confirms that the information supplied is accurate and that the customer has read and accepted these Terms and Conditions, together with our Shipping & Delivery Policy, Returns & Refunds Policy and Privacy Policy.

Nothing in these terms excludes or limits any consumer right that cannot lawfully be excluded under South African law.

Products and Product Information

We make reasonable efforts to describe and display our products accurately. Product photographs are illustrative / informative and may show differences in colour, texture, packaging or appearance.

Pizza cones are food products manufactured and packaged according to our applicable production and preservation processes. Minor natural variations in shape, surface texture, colour or dimensions are not necessarily defects. It is a hand-made finish.

Product dimensions, capacities, compatibility information and operating guidance are provided to assist customers. Customers must confirm that equipment dimensions, electrical requirements, gas requirements and product compatibility are suitable for their intended use before ordering.

Product availability, specifications, packaging and prices may change without prior notice. Changes will not affect an order already accepted unless agreed with the customer. Quotes can be valid for 7 (seven) days.

Prices and Currency

All prices are displayed in South African Rand.

The complete order total, including applicable courier charges, will be displayed before the customer submits payment. In the case where the courier fee has been omitted or wrongly calculated, we reserve the right to correct it.

Piping Hot Pizza Cones is not registered as a VAT vendor and does not issue VAT tax invoices unless this status changes and the website is updated accordingly.

Obvious pricing, typographical or system errors may be corrected. If an error affects an order already placed, we will contact the customer before proceeding and offer the customer an opportunity to confirm or cancel the order.

Placing an Order

The customer must review the cart/quote/pro-forma invoice, quantities, delivery information and total amount before placing an order.

Submitting an order constitutes an offer to purchase the selected products. An automated order acknowledgement confirms that the order has been received, but does not necessarily constitute final acceptance.

An order is accepted once payment has been confirmed and we have accepted the order for fulfilment. We may contact the customer where stock, delivery, pricing, security or order information requires clarification. The appearance of a deposit in our bank signals an order.

We reserve the right to decline or cancel an order where:

• payment cannot be confirmed;
• a product is unavailable;
• the customer’s information is materially incomplete or incorrect;
• the transaction appears unauthorised or fraudulent;
• delivery cannot reasonably be arranged; or
• an obvious website or pricing error has occurred.

Where we cancel a paid order, the relevant refund will be negotiated.

Payment

Online payments are processed through Yoco/EFT or another payment provider identified during checkout.

Customers must use a payment method that they are legally authorised to use. Card and payment information is handled according to the payment provider’s security processes.

We do not intentionally store complete card details on our website.

An order will not be dispatched or made available for download until payment has been successfully confirmed, unless we expressly agree otherwise.

Stock Availability

Products are sold subject to availability.

If a product becomes unavailable after payment, we will contact the customer and offer an appropriate alternative, delayed fulfilment, partial fulfilment or refund.

We are not responsible for a customer’s indirect loss resulting from stock becoming unavailable, except to the extent that liability cannot lawfully be excluded.

Physical Product Delivery

Physical products are delivered only within South Africa unless a separate written arrangement has been made.

Approximate courier fees are calculated according to the applicable rules (estmated) displayed during checkout:

• 1–3 physical items: R100
• 4–8 physical items: R150
• 9–12 physical items: R300
• 13–18 physical items: R400
• 19–24 physical items: R500

Orders exceeding 24 physical items require an individual delivery quotation.

Orders received and paid for by Saturday are normally dispatched on the following Monday. Where payment for a Sunday order is confirmed in time, we will endeavour to include that order in the following Monday’s dispatch.

Orders dispatched on Monday are expected to arrive on Wednesday or Thursday. Delivery dates are estimates and may be affected by courier operations, remote locations, public holidays, weather, road disruptions or circumstances beyond our reasonable control.

Customer Delivery Information

The customer is responsible for supplying a complete and accurate delivery address, postal code, telephone number and email address. Delivery is typically arranged to the nearest courier depot or shop/kiosk, not customer’s physical address. Customers are to promptly collect products and keep food items permanently frozen.

Additional costs caused by an incorrect address, failed delivery attempt or customer-requested redirection may be payable by the customer.

Customers should promptly notify us if delivery information must be corrected. Address changes cannot be guaranteed after dispatch. We take no responsibility for the request of more “convenient” delivery locations.

Food Products

Pizza cones and other edible products are subject to food-safety, hygiene and traceability controls.

Food that has left our control cannot be returned to our stock, storage or distribution system, even where the packaging appears unopened. Customers must not send food products back unless expressly instructed in writing.

If a food product is damaged, unsafe, defective or incorrectly supplied, the customer should retain the product and packaging temporarily, refrain from consuming any product believed to be unsafe, and contact us with photographs and the order number.

We will discuss the matter with the customer and determine an appropriate resolution, which may include replacement, refund, credit or another agreed remedy, subject to applicable statutory rights.

Non-food Equipment and Accessories

Equipment and accessories must be used according to their supplied instructions and intended purpose.

Customers are responsible for:

• confirming product suitability and compatibility;
• following safety and operating instructions;
• using competent persons where installation or technical work is required;
• complying with applicable gas, electrical, fire, health and workplace requirements; and
• ensuring appropriate supervision, cleaning and maintenance.

Unauthorised modifications, misuse, incorrect installation, abnormal operating conditions or failure to follow instructions may affect product performance and available warranty remedies, subject to applicable law.

Returns and Refunds

Returns, cancellations, defective products and refunds are governed by our Returns & Refunds Policy and applicable South African law.

Where an online cooling-off right applies to non-food goods, the customer may be responsible for the direct cost of returning change-of-mind goods as well as handling fees.

Qualifying defective, unsafe or failed goods remain subject to the statutory remedies provided under the Consumer Protection Act.

Downloadable Products

Downloadable products are supplied electronically and do not attract courier charges.

After successful payment, the customer will receive access through the order confirmation, customer account or secure download link. Download limits and expiry periods displayed in the order apply.

Customers should download and securely retain their purchased files within the permitted period.

Digital Product Licence

The purchase of the Pizza Cone Business Blueprint E-book or another digital product grants the purchaser a limited, non-exclusive and non-transferable licence to use the material for the purchaser’s own learning, planning and lawful business development.

The purchaser may not, without written permission:

• resell or redistribute the file;
• share the download link with another person;
• upload the material to a public or shared/torrent platform;
• reproduce substantial portions for commercial distribution;
• remove ownership, copyright or attribution notices; or
• represent the material as the purchaser’s own work.

Unauthorised copying or distribution may constitute copyright infringement.

Intellectual Property

The website and its contents—including text, photographs, graphics, training material, product designs, business methods, logos, brand elements and downloadable material—are owned by or licensed to Piping Hot Pizza Cones.

No content may be copied, modified, republished, sold, distributed or commercially exploited without prior written permission, except where permitted by law.

The names Piping Hot Pizza Cones, Unicus, PizzaFry7, UniTray12, UniStand, UniOven, UniView, Mini Pizza Cones or Mini+ Pizza Cones, Large Pizza Cones or Maxi Pizza Cones and associated branding may not be used in a manner that falsely suggests authorisation, endorsement or affiliation.

Website Accounts

Customers are responsible for protecting their login details and restricting access to their accounts.

Customers must notify us promptly if they believe that an account or download link has been accessed without permission.

We may suspend access where reasonably necessary to protect the customer, the website, intellectual property or other users.

Website Availability and Security

We take reasonable measures to maintain the website and protect transactions. However, uninterrupted or error-free access cannot be guaranteed.

The website may be temporarily unavailable because of maintenance, hosting interruptions, software updates, security work or circumstances beyond our control.

Customers must not attempt to interfere with the website, bypass security controls, introduce malicious software, scrape protected content or gain unauthorised access to any system or account.

The website may contain links to third-party websites or services. These links are supplied for convenience and do not necessarily constitute endorsement.

We are not responsible for the content, availability, security or privacy practices of independent third parties.

Limitation of Liability

To the maximum extent permitted by law, Piping Hot Pizza Cones will not be liable for indirect, incidental or consequential loss, loss of profit, loss of business opportunity or loss arising from unauthorised or improper product use.

Nothing in these terms excludes liability for gross negligence, fraudulent conduct, unsafe or defective goods, or any other liability that cannot lawfully be excluded.

Our liability will always remain subject to the Consumer Protection Act and other applicable South African law.

Events Beyond Reasonable Control

We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including severe weather, fire, flood, road disruption, courier interruption, labour action, power failure, telecommunications failure, supplier interruption, civil disturbance, government restriction or similar events.

We will make reasonable efforts to communicate material delays and find a practical solution.

Please include the order number, relevant dates, a clear description of the complaint and supporting evidence.

We will attempt to resolve complaints reasonably and in good faith. If a dispute cannot be resolved directly, the customer may use any consumer-protection body, alternative dispute-resolution process or court having jurisdiction.

Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be subject to the jurisdiction of the appropriate South African court, tribunal or consumer-protection body.

Changes to These Terms

We may update these Terms and Conditions when business practices, products, technology or legal requirements change.

The version applying to an order is ordinarily the version published when that order was placed.
